Electronic Signature and Electronic Record Consent

This Electronic Signature and Electronic Record Consent ("E-Sign Consent") applies to your use of Rehive's services and any related transactions. By agreeing to this E-Sign Consent, you consent to the use of electronic records and electronic signatures as described below.

1. Scope of Consent

By providing your consent, you agree that Rehive ("we," "us," or "our") may provide you with any and all communications, agreements, documents, notices, and disclosures (collectively, "Communications") electronically rather than in paper form. This includes, but is not limited to:

  • Terms of Service and any amendments thereto
  • Privacy policies and notices
  • Account-related communications and transaction confirmations
  • Legal and regulatory disclosures
  • Billing statements and payment receipts
  • Customer service communications
  • Any other agreements or documents related to your use of our services

2. Consent to Electronic Signatures

You agree that your electronic signature, whether by clicking "I Agree," "Accept," "Submit," or similar button, typing your name, or using any other electronic means of acceptance, has the same legal effect as your handwritten signature. You acknowledge that your electronic signature on any agreement or document is legally binding and enforceable.

Under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) (15 U.S.C. § 7001 et seq.) and applicable state laws, electronic signatures and electronic records have the same legal validity as traditional paper documents and handwritten signatures.

3. Hardware and Software Requirements

To access, receive, and retain electronic Communications, you will need:

  • A computer, mobile device, or other device with internet access
  • A current web browser that supports Transport Layer Security (TLS) 1.2 or higher, such as the current versions of Chrome, Firefox, Safari, or Edge
  • A valid email address
  • Sufficient storage space to save Communications or a printer to print them
  • Software capable of viewing PDF files, such as Adobe Acrobat Reader (available free at https://get.adobe.com/reader/)

By consenting to receive Communications electronically, you confirm that you have the necessary hardware and software to receive, access, and retain electronic Communications.

4. How We Provide Electronic Communications

We may provide electronic Communications to you by:

  • Sending them to the email address you have provided to us
  • Posting them on our website or within your account dashboard
  • Sending push notifications or in-app messages if you use our mobile applications
  • Any other electronic means reasonably designed to provide you with the Communications

5. Keeping Your Contact Information Current

It is your responsibility to keep your email address and other contact information current. You can update your contact information by logging into your account or by contacting us at [email protected].

If your email address becomes invalid or we are unable to deliver electronic Communications to you, we may treat your account as inactive and may suspend or terminate your access to our services until you provide a valid email address.

6. Paper Copies

We will provide you with a paper copy at no charge, unless otherwise stated. Your request for a paper copy will not affect your consent to receive electronic Communications or any other terms of your agreement with us.

7. Withdrawal of Consent

You may withdraw your consent to receive electronic Communications at any time by contacting us at [email protected]. Your withdrawal of consent will be effective after we have had a reasonable opportunity to process your request, typically within five (5) business days.

Please note that withdrawal of consent may affect your ability to use our services, as certain features and functionality may require electronic Communications. If you withdraw your consent, we may terminate your account or limit your access to certain services. Withdrawal of consent will not affect the legal validity or enforceability of any electronic Communications or signatures provided prior to the effective date of withdrawal.

8. Legal Effect

Your consent to this E-Sign Consent means that:

  • Electronic Communications satisfy any legal requirement that such Communications be in writing
  • Electronic signatures are legally binding and have the same effect as handwritten signatures
  • You waive any right or requirement under any law or regulation that requires a signature or delivery of non-electronic records
  • Electronic records may be used as evidence in legal proceedings to the same extent as paper records

9. Retention of Records

We recommend that you print or download a copy of this E-Sign Consent and all other Communications for your records. You may print or save a copy of any Communication by using the print or save function in your browser or email application. We will retain electronic records of Communications in accordance with our record retention policies and applicable law.

10. Federal and State Law

This E-Sign Consent is governed by the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and the Uniform Electronic Transactions Act (UETA) as adopted by applicable states, as well as any other applicable federal or state laws regarding electronic signatures and electronic records.

11. Changes to This Consent

We may modify this E-Sign Consent at any time. If we make material changes, we will notify you by posting the updated E-Sign Consent on our website and, where required by law, by sending you an email or other notification. Your continued use of our services after such changes constitutes your acceptance of the modified E-Sign Consent.
